Questions & Answers

In an effort to assist injury victims in their search for information, Tulsa’s Personal Injury Attorney Richard Shallcross has answered some of the most common questions related to injury claims. The following explanations should not be construed as legal advice. Understandably, each case presents a different set of facts and issues. • Explain in a nutshell what you do and why you do it.

I left the business world and got into law to help people with problems they can’t solve themselves. Before I was a lawyer, I specialized in problem-solving. I have worked in engineering, and I have worked in accounting as a licensed CPA. Shallcross & Associates seeks to give voice in Court to the poor, weak, or disadvantaged victim of somebody else’s negligence. As a medical malpractice lawyer in Tulsa, I fight against popular hospitals, likable doctors, big name employers and cheap, dishonest insurance companies to seek a just result for the injured patients and consumers and workers of Northeast Oklahoma.

  • Give us some examples of fights that you won.

I had a client who had been turned down repeatedly for disability despite the fact that she had a condition that prevented her from working in any job. There were a lot of obstacles. I had to appeal The Administrative Law Judge’s decision to The Appellate Council in Washington, but we won. That wasn’t the most profitable case I’ve ever taken, but we made a significant difference in that client’s life.

Our firm has a lot of experience in the areas of medical malpractice and hospital negligence. Birth injuries are among the most traumatic cases. The birth of a child is supposed to be a joyous, momentous event. Expecting parents rely on obstetricians, nurses, and other medical professionals to make proper use of the medical technology at hand and to make appropriate decisions. When this doesn’t happen, those professionals need to be held responsible. One young woman’s first pregnancy was completely normal until the day of delivery. Although monitors showed that there was reason to believe the fetus was in distress, the medical team continued to attempt a vaginal delivery. The child suffered a profound brain injury due to a lack of oxygen during the last 30 minutes of delivery. Experts determined that the cost of care over the life of the child would be $7.5 million. All of the obstetricians and the hospital denied liability, so we filed a lawsuit to seek justice, and we were successful. The final terms are confidential, but the case settled just prior to trial.

  • What is the best advice you can give to someone looking for justice?

If you are looking for justice from wrongful injury or death due to negligence, the truth will be your friend. I tell this to all my clients. Don’t get yourself in a situation where you have to back-up on your prior statements and try to remember what you said. Invariably, the truth is our friend. It’s the other guy who made the mistake and who will invariably lie to avoid liability.

  • Why do people choose Shallcross over the many other firms out there?

There are several reasons why families choose Shallcross &Associates. First, I’ve been a practicing attorney for over 30 years, so I get respect from the opposition that many other attorneys don’t.  Second, my staff and I are passionate about the law, but we never forget that our clients are real people. We treat our clients with respect and kindness. We’re on your side, and we’re here to help. Third, I spent three and a half years on active duty in the Army. I developed a strong sense of duty and honor as an infantry officer and a helicopter pilot, and I’m proud of my service to our country during the Vietnam conflict. I will serve you and your family with the same professionalism and dedication.
